1. Introduction

Welcome to KAKEHASHI LTD. These Terms and Conditions (“Terms”) govern your use of our website and services that connect instructors (“Tutors”) and learners (“Students”) for lessons related to Japanese culture, both online and in person. By registering for an account or using our platform, you agree to be bound by these Terms. If you do not agree, you must not use our services.

2. Role of the Platform

This platform acts solely as an intermediary platform connecting Tutors and Students.
– We do not employ Tutors, and we are not a party to any contract between Tutors and Students.
– We are not responsible for the quality, safety, legality, or outcome of any lessons.
– All lessons are provided under the responsibility of the Tutor.

3. Account Registration

– You must be at least 18 years old to register.
– You agree to provide accurate and up-to-date information when creating an account.
– You are responsible for maintaining the confidentiality of your login credentials.
– Accounts may not be shared with or transferred to another person.

4. Bookings and Cancellations

– Bookings must be made through the platform.
– Cancellations made at least 24 hours before the scheduled lesson are eligible for a full refund.
– Cancellations made less than 24 hours before the lesson are non-refundable.
– If a Tutor cancels a lesson, Students will receive a full refund.
– For in-person lessons, Students are responsible for their own transportation, health, and safety.

5. Fees and Payments

– Fees for lessons are displayed at the time of booking.
– Payments are processed securely via WooCommerce Payments. We accept major credit and debit cards, as well as Apple Pay and Google Pay.
– The platform charges a 20% service fee, which is included in the price displayed.
– Refunds are subject to the cancellation policy above.

6. Responsibilities of Users

Tutors:

– Must provide accurate information about their qualifications and lessons.
– Are responsible for the safety and legality of the lessons they conduct.
– Must comply with all applicable UK laws and regulations (e.g., food safety for cooking lessons).

Students:

– Must ensure they are physically and mentally fit to participate in lessons.
– Are responsible for taking reasonable care during in-person lessons.
– Must not engage in any unlawful, harmful, or disruptive behavior.

7. Code of Conduct

– Users must treat each other with respect.
– Harassment, discrimination, or abusive behavior will not be tolerated.
– Users must not attempt to bypass the platform by arranging lessons directly outside the platform.

8. Intellectual Property

– All content provided on the platform (text, images, logos, design) is owned by KAKEHASHI LTD and protected by intellectual property laws.
– Tutors retain ownership of their teaching materials but grant the platform a limited license to display them on the site.
– Students may not copy, reproduce, or distribute lesson materials without permission.

9. Liability and Disclaimers

– The platform is not liable for any injuries, damages, or losses arising from lessons, whether online or in person.
– Tutors and Students are solely responsible for ensuring a safe environment.
– We make no guarantees about the availability, reliability, or accuracy of the services.

10. Privacy and Data Protection

We process personal data in accordance with the UK GDPR and our Privacy Policy, which is incorporated into these Terms by reference.

11. Termination

We may suspend or terminate your account at any time if you violate these Terms, engage in unlawful activity, or misuse the platform.

12. Amendments

We may update these Terms from time to time. Any changes will be posted on our website, and your continued use of the platform constitutes acceptance of the updated Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the platform will be subject to the exclusive jurisdiction of the courts
